When to decide for an enforcement?
Before enforcement it is very important to regularly contact the debtor and remind him of his outstanding obligations towards you. Try to figure out why he hasn’t fulfilled his obligations and in the case of liquidity problems, try to agree on payment in instalments. Always keep in mind that you probably aren’t the only creditor of the debtor and that waiting with debt collection is, therefore, irrelevant and pointless.
Why can’t we collect the money ourselves?
You can always try to collect the debt on your own, but so far this has often proved to be the wrong move, despite persistently reminding the debtor. Timely handover of claims to an experienced team increases the possibility of debt repayment. Experience to date show that a letter sent by the creditor is less effective than a letter with the same content sent by a debt collection company.
Are all claims collectible?
Claim collection always depends on the age of the claim and on the debtor’s financial situation. Thus, it is never possible to collect all of the claims. It should be noted that the most important factor of success is time, which to a large extent decides the recoverability of the debt.
How can I check if the company’s bank account is already blocked?
Companies can be checked at any time free of charge at the website of AJPES. You can access it via the following link: http://www.ajpes.si/eRTR/JavniDel/Iskanje.aspx. In cases of blocked company bank accounts, a red letter R is displayed on the right.
Is judicial collection the only way for repayment from my debtor?
No. First, each creditor is always proposed extrajudicial settlement with his debtor, where we try to agree with the debtor on an option of repayment, be it in full or in instalments. Still, it is important to monitor the debtor’s payments and, based on that, decide on further procedures. Legal cases demand high financial investment, while extrajudicial collection gets claims repaid faster and provides information regarding the necessity or viability of enforcement.
What are the advantages of collaborating with us?
We work using modern debt collecting techniques and methods. We guarantee full consideration of your claims and we have the most technologically advanced system for monitoring claims. Let us take care of your debtors, while you focus on your core business.
What information do you need us to provide for quality debt collection?
High quality recovery requires from the creditor as much information as possible about the debtor, because it eases and speeds up the collection process. It is necessary that the creditor submits the overdue accounts, delivery notes, purchase orders and contracts. Also, we urgently need the statement of open claim and liability positions, all activities with the debtor, debtor’s documentation and contact information (comprising his name, surname, address, tax ID number and social security number). With the obtained information, agreement and signed contract we then proceed to collect.
What costs are incurred by the collection procedure?
Collection costs are determined individually, taking into account the age of the claim, the sum of the claim and the number of submitted claims.
Which data and documentation do you need for a successful procedure?
It is advisable to obtain as much information about the debtor as possible, because it eases and speeds up the collection process. The creditor has to submit all available documentation from which the debt and the debtor’s contact information are evident.
